These Terms of Service ("Terms") govern your access to and use of Pexify, the commerce operations platform operated by SARAWELL LLC ("Pexify", "we", "us"). By using Pexify, you agree to these Terms.
Pexify provides software that connects your products, inventory, marketplace listings, orders, fulfillment, suppliers, and shipping, and that lets you connect authorized marketplace and store accounts to manage commerce operations. Features may change as we improve the platform.
You must provide accurate information and keep your account credentials secure. You are responsible for activity under your account. You must be authorized to use and connect any marketplace or store account you connect to Pexify.
When you connect a marketplace or store, you authorize Pexify to access and process data from that account to provide the functions you request, as described in our Privacy Policy. You may disconnect a connected account at any time. You are responsible for complying with the terms and policies of any marketplace you connect (including Amazon, Etsy, and Shopify).
You agree not to misuse the service, including by attempting to access it without authorization, interfering with its operation, violating applicable law, or infringing the rights of others.
Pexify is currently offered through an early-access program with pricing based on connected stores, order volume, and selected operational services, as agreed with you. Applicable fees, billing, and payment terms will be provided to you and form part of these Terms.
Pexify and its software, content, and trademarks are owned by SARAWELL LLC or its licensors. You retain your own data and content. You grant us the rights needed to process your data to provide the service.
The service integrates with third-party marketplaces and providers. We are not responsible for third-party services, and your use of them is subject to their terms.
The service is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the service will be uninterrupted or error-free.
To the maximum extent permitted by law, SARAWELL LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising out of or related to your use of the service.
You may stop using Pexify and disconnect your accounts at any time. We may suspend or terminate access if you violate these Terms or to protect the platform. Provisions that by their nature should survive termination will survive.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws rules.
